Definitions of Terms Used in the Terms and Conditions

Consumer — a natural or legal person who expresses the desire to purchase, purchases, or may purchase a product or use a service for a purpose not directly related to their business activity.

Buyer — a person who makes a purchase of goods in the Seller’s online store. The Buyer may be both a Consumer and a person who is not a Consumer.

Product — any item offered or sold by the Seller to the Consumer through this website.

Manufacturer — a person who, within the scope of their economic or professional activity, manufactures or refurbishes a product for sale or presents themselves as the Manufacturer by marking the product, its packaging, or its technical documentation with their name, trademark, or other distinguishing mark.

Regulatory Acts — Cabinet of Ministers Regulations No. 255 “Regulations on Distance Contracts” of May 20, 2014, Consumer Rights Protection Law, Civil Law, Commercial Law, and other applicable regulatory acts.

Warranty — a commitment by the Manufacturer, Seller, or service provider that the Product or service, or its component, will retain its usage properties, safety, and performance for a certain period, and that the Manufacturer, Seller, or service provider assumes additional obligations not specified in this law or other regulatory acts.

Usage Instructions — instructions provided by the Manufacturer or Seller, which, when followed, ensure that the Product retains its usage properties and proper quality, as well as does not pose a threat to the Consumer’s property, health, life, or environment.

Prices — the final price of the Product indicated on the Website, including taxes and fees, at which the Seller sells the Products through this website. The price does not include delivery costs.

Website — the Seller’s website www.winterstyle.lv.

Parties — the Seller and the Buyer.

General Terms and Conditions — these terms (General Terms and Conditions of the Website)

1. General Provisions

1.1. These terms define the legal relationship between the Buyer and the Seller.

1.2. Before using the Website, please carefully review these Terms of Use.

1.3. By using the Website, the user agrees to comply with these Terms.

1.4. The Seller may partially or fully delete, modify, or supplement the information on the Website without prior notice.

1.5. The images and descriptions of the displayed products may slightly differ from the offered Product.

2. Right of Withdrawal

2.1. The Consumer has the right to use the right of withdrawal and unilaterally withdraw from the Product within 14 (fourteen) days, covering delivery costs, in accordance with regulatory acts.

2.2. The withdrawal period is counted from the day the Product is delivered — if one Product is ordered; from the day of delivery of the last Product — if multiple Products are included in the order; from the day of delivery of the last batch or part of the Product — if delivery is made in batches or parts.

2.3. The use of the right of withdrawal means the Buyer notifying the Seller about the withdrawal and submitting or sending it to the Seller.

2.4. The Consumer may use a withdrawal form provided by the Seller or another freely formatted withdrawal statement, which must include:

• Recipient (Seller’s name, actual address, phone number, email address)
• “I hereby declare that I wish to withdraw from the purchase of the following Product”
• Order date/receipt date
• Consumer’s name and surname
• Consumer’s address
• Consumer’s signature (only if submitting on paper)
• Date

2.5. The returned Product must be delivered by the Consumer to Ogres nov., Tīnūžu pag., “Viduslīdumnieki”, LV-5015, and must be in full set.

2.6. When using the right of withdrawal, the Consumer may return the Product without packaging if it was not possible to examine the Product without opening the packaging.

2.7. Sending the withdrawal form or statement within the period terminates the contract and releases the Consumer from any contractual obligations.

2.8. The Consumer cannot use the right of withdrawal if the Product is custom-made or clearly personalized, quickly perishable, or if the packaging is opened for hygiene and health reasons.

2.9. The refund is processed using the original payment method.

3. Consumer Responsibility

3.1. The Consumer is responsible for the decrease in the Product’s value if used beyond what is necessary for its characteristics and examination.

3.2. The Consumer must return the Product to the Seller within 14 days after sending the withdrawal notice.

3.3. The Consumer is responsible for preserving the quality and safety of the Product during the withdrawal period.

4. Warranty

4.1. The Consumer has the right to file a claim within two years from the Product’s purchase date.

4.2. If the Manufacturer or Seller provides a warranty, the Consumer can file a claim according to the warranty terms.

4.3. The Consumer must attach a copy of the proof of purchase to the claim.

4.4. The claim will be reviewed within seven business days.

5. Delivery

5.1. Delivery times are approximate.

5.2. If the recipient is not reachable, the order is returned and re-delivered at an additional cost.

7. Dispute Resolution

Latvian law applies to these Terms.
